Petition filed in LHC challenging 27th Amendment

A petition has been filed in the Lahore High Court (LHC) challenging the recently passed 27th Constitutional Amendment.

The petition was submitted by lawyers Muneer Ahmed and Mian Shabbir Ismail, who argued that the amendment contradicts the basic framework of the 1973 Constitution. The petitioners claimed that the changes undermine the spirit of the Constitution and alter the balance of judicial authority.

According to the plea, the amendment strips the Supreme Court of its original jurisdiction, effectively placing the newly formed Federal Constitutional Court above it. The petitioners warned that this shift could weaken the status of the Supreme Court and pose a threat to judicial independence.

They further argued that the current parliament does not qualify as a “true constitutional assembly” and therefore lacks the mandate to introduce such far-reaching amendments.

The petition also states that the changes violate key Islamic provisions, judicial autonomy, and fundamental rights guaranteed in the Constitution. It urges the Lahore High Court to strike down the amendment, terming it unconstitutional and detrimental to democratic principles.
