Plea has challenged judge’s degree, not his conduct, says IHC

The Islamabad High Court (IHC) on Wednesday issued a written order regarding hearing on the Justice Tariq Jahangiri degree dispute case.

The written order issued by a two-member bench headed by Chief Justice Sarfaraz Dogar said that the government lawyers, judicial assistant and the petitioner were heard on the merits of the petition. The Islamabad Bar Association and the Islamabad Bar Council were also heard.

It said that the petitioner has challenged the qualification of Justice Tariq Mahmood Jahangiri, not his conduct. This petition is hearable in the light of the decisions of the Supreme Court. The petition is also declared hearable in the light of the Supreme Court’s order in the Justice Jahangiri case.

It said that the petition is admissible in the light of the order of Supreme Court in Abrar Hassan case and Malik Asad Ali case. The petition is also maintainable in the light of the Sindh High Court’s full bench decision.

A notice is issued to Justice Jahangiri in the light of the petitioner’s position regarding the degree dispute and the university’s report.Three notices were also issued to the federal government and other parties in the petition. The court has adjourned further hearing on the petition against the appointment of Justice Jahangiri until December 15.
