LHC upholds wife’s right to property promised in marriage agreement

The Lahore High Court (LHC) has ruled that a husband is legally bound to fulfill commitments made to his wife in a separate marriage related agreement in addition to paying the dower (Haq Mehr) specified in the Nikahnama.

In a detailed 11-page judgment, Justice Muhammad Sajid Mahmood Sethi upheld a trial court’s decision directing a husband to transfer a five-marla house to his wife, as promised in a separate agreement executed on the day of their marriage. The court dismissed the husband’s plea seeking to overturn the trial court’s verdict.

According to the judgment, the promise of the property was made independently of the Haq Mehr mentioned in the marriage contract. The court held that such commitments, when voluntarily undertaken and properly documented, carry legal significance and can be enforced.

The ruling emphasized that Haq Mehr is a legally protected right of a wife and should not be viewed as a favor or discretionary benefit granted by the husband. Under Islamic and family law principles, the court observed, Haq Mehr is treated as a debt owed by the husband to the wife.

The judgment further stated that a woman’s failure to demand Haq Mehr during marriage cannot be interpreted as a waiver of her right. The court noted that social, cultural, and domestic pressures often prevent women from asserting their financial rights during marriage, and such circumstances must be taken into account.

Justice Sethi observed that family courts should not focus solely on technical legal interpretations but must also consider the broader social realities surrounding matrimonial disputes. The court highlighted the need to safeguard women’s legal and financial rights within the framework of family law.

The judgment also noted that Haq Mehr may be determined verbally, in writing, or even after marriage, and that Islamic law allows an increase in the amount of dower after the marriage contract has been concluded.

Legal experts believe the ruling reinforces the enforceability of commitments made in marriage-related agreements and strengthens protections for women seeking to claim rights promised to them at the time of marriage.

The decision is expected to serve as an important reference in future family law disputes involving matrimonial agreements and financial obligations.
