Hong Kong court overturns Jimmy Lai fraud conviction

A Hong Kong court has overturned the fraud conviction and prison sentence of pro-democracy media tycoon Jimmy Lai, marking a rare legal victory amid his ongoing 20-year national security sentence. Judges Jeremy Poon, Anthea Pang, and Derek Pang allowed the appeal, noting that the lower court judge had erred in interpreting the law and applying it to Lai’s business operations. The ruling specifically quashed the conviction linked to his company Dico Consultants Ltd.

The Court of Appeal emphasized that Lai and another defendant were wrongly held liable for concealing operations of Dico Consultants at Apple Daily’s headquarters. The judges stated the lower court’s reasoning was “unsupportable” and highlighted errors in determining that the applicants owed a duty to disclose lease breaches. Lai’s lawyer argued that Dico primarily supported publishing operations, which fell under normal media business practices rather than fraudulent activity.

Despite the overturned fraud conviction, Lai remains imprisoned for two counts of conspiracy to collude with foreign forces and publishing seditious materials under the national security law. Human rights groups and foreign governments, including the United States and Britain, have criticized his imprisonment, calling attention to Lai’s deteriorating health after more than five years in solitary confinement. His son Sebastien stressed that the legal victory does not change his father’s continued incarceration.

Lai, 78, has experienced severe health issues during detention, including retinal vein occlusion, high blood pressure, heart palpitations, progressive hearing loss, and prolonged confinement in a maximum-security facility. Advocates warn that continued imprisonment without proper medical care could threaten his life. The court’s decision, however, reinforces the importance of judicial oversight in ensuring procedural fairness even in politically sensitive cases.

The Department of Justice in Hong Kong has stated it will review the judgement to determine whether to appeal the decision. Meanwhile, the ruling has drawn global attention to the broader crackdown on pro-democracy voices in Hong Kong following Beijing’s national security law after the 2019 mass protests. International leaders, including US officials, have expressed concern over Lai’s treatment and emphasized the need for accountability and respect for human rights.
